These Terms of Service ("Terms") are a binding legal agreement between you and Nikolas Carruthers, doing business as ParkGuard ("ParkGuard," "we," "us," or "our"), governing your use of the ParkGuard mobile application (the "App") and any related services (together, the "Service").

PLEASE READ THESE TERMS CAREFULLY, INCLUDING THE ARBITRATION AND CLASS ACTION WAIVER IN SECTION 14, WHICH AFFECTS YOUR LEGAL RIGHTS.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. What ParkGuard Is — and Is Not

ParkGuard is a convenience tool that estimates street-sweeping and parking-restriction schedules using publicly available municipal data and helps you track where you've parked. ParkGuard is not an official source of parking regulations and does not guarantee the accuracy, completeness, or timeliness of any schedule, restriction, or notification it provides.

Street signage always controls. Posted parking signs, curb markings, and posted municipal notices are the only legally authoritative source of parking restrictions in any given location. Schedules, holidays, temporary suspensions, construction closures, special events, and city-specific exceptions may not be reflected in the App's data, may change without notice, or may be sourced from data that is delayed, incomplete, or incorrect. You are solely responsible for reading and complying with all posted signage at your actual parking location, regardless of what the App displays or predicts.

2. No Responsibility for Tickets, Towing, Booting, or Fees

YOU ACKNOWLEDGE AND AGREE THAT PARKGUARD IS NOT RESPONSIBLE, IN WHOLE OR IN PART, FOR ANY PARKING CITATION, FINE, PENALTY, TOWING CHARGE, BOOTING FEE, IMPOUND FEE, STORAGE FEE, OR ANY OTHER COST, LOSS, OR CONSEQUENCE ARISING FROM WHERE, WHEN, OR HOW YOU PARK YOUR VEHICLE, whether or not:

• the App failed to send a notification;
• a notification was sent late, early, or with incorrect information;
• the App's detected location, address, or street-sweeping schedule was inaccurate;
• you relied on the App instead of, or in addition to, posted signage; or
• the App was unavailable, malfunctioning, or not running at the relevant time (including due to iOS killing background processes, notification permissions being denied or revoked, Do Not Disturb settings, device power-off, lack of connectivity, or any other reason).

Using ParkGuard does not create any obligation on our part to prevent you from receiving a citation, and does not shift any portion of that responsibility from you to us. You remain fully and solely responsible for your vehicle, where you park it, and compliance with all applicable parking laws at all times.

3. Eligibility

You must be at least 13 years old to use the App, and if you are under 18, you must have a parent or guardian's permission and that parent or guardian must agree to these Terms on your behalf. By using the App, you represent that you meet these requirements and that you have the legal capacity to enter into this agreement.
