These Terms of Service ("Terms") are a binding agreement between you and Nikolas Carruthers, doing business as ParkGuard ("ParkGuard," "we," "us," or "our"), governing your use of the ParkGuard app for iPhone and Apple Watch, its widgets and Live Activities (the "App"), and related services (together, the "Service").

PLEASE READ THESE TERMS CAREFULLY. SECTION 20 REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS. YOU MAY OPT OUT WITHIN 30 DAYS.

By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

Apple's license agreement also applies. Your license to use the App is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms add to the Standard EULA. If they conflict, the Standard EULA controls as to your license to use the App, and these Terms control as to everything else, to the extent the law allows.

1. What ParkGuard is — and is not

ParkGuard is a convenience tool. It helps you remember where you parked, estimates the parking rules that may apply there using public city data, signs you scan and reports from other users, and reminds you before those rules may apply.

ParkGuard is not an official source of parking rules. It is not affiliated with, endorsed by or acting for any city, parking authority, or parking payment service.

Posted signs and curb markings always control. Temporary restrictions, construction, special events, holidays, recent changes and errors in city data may not be reflected in the App. You are solely responsible for reading and obeying all posted signs and parking laws where you actually park, whatever the App shows.

2. Use ParkGuard safely

Do not use or look at the App while driving. Parking detection runs automatically so you don't need to. Pull over and park safely before interacting with your phone, and always obey traffic laws and your vehicle's safety guidance. You are responsible for any consequence of using your phone while operating a vehicle.

3. No responsibility for tickets, towing or fees

PARKGUARD IS NOT RESPONSIBLE, IN WHOLE OR IN PART, FOR ANY PARKING CITATION, FINE, PENALTY, TOWING, BOOTING, IMPOUND OR STORAGE FEE, OR ANY OTHER COST OR LOSS ARISING FROM WHERE, WHEN OR HOW YOU PARK, including where:

• the App did not detect that you parked, or saved the wrong location;
• the App did not send a reminder or alarm, or sent one late, early or with wrong information;
• a parking rule, schedule, location, side of the street, meter rate or time shown by the App was wrong, incomplete or out of date;
